Philips Viral Video Competition
The competition will run from June 15th, 2009 to July 10th, 2009 (“Term”). Participants must submit their viral video idea. The prize-winners will be the participants submitting the most original entry. The 3 most creative winners will be picked by the Philips jury at the end of the Term.
General Competition Rules:
These are the rules (“Rules”) for participation in a competition on the Twitter website. Submitting an entry to any competition on the Twitter website signifies explicit acceptance of these Rules (including the specific details for each separate competition and the Terms of Use and Privacy Policy linked in the footer of this page).
- Participants may enter a competition on the Twitter website via digital entry. To submit an entry to a competition on the Twitter web site, fill out the fields required as directed and follow these Rules (including the specific details for the particular competition as shown on the web site). The competition is open to everyone over 18 years of age.
- By submitting their entry, the participant warrants that they are the originator of the submitted material and that by submitting the material no third party intellectual property rights have been infringed. The winners of each competition will be picked by a jury appointed by Philips.
- Only those entries submitted and received in good order by Philips before the end of the Term (as set out in the specific details for each competition) shall be deemed valid and shall be taken into consideration. Submissions which are incomplete, illegible, lost or damaged shall not be taken into consideration. Philips accepts no liability whatsoever for any problems or any deficiency concerning computers, connections or networks used in submitting an entry through the web site. The winners will be notified at the end of the term by e-mail to the e-mail address given in competition registration page. This e-mail will contain information about the prize and how to redeem it. If the prize is declined, or unclaimed before 10th August 2009, after Philips has sent out the notification e-mail or if the prize winner cannot be contacted via the details submitted in the competition registration page, a substitute winner may be chosen at Philips’ sole discretion and such new winner will then be notified by email. The original winning entry will then be forfeited.
The names of the prize-winners will be published on www.philips.com/ofcourse. By entry into this competition you hereby give us the right to use your name to identify you as a winner on our website in case you will be indeed the winner of this competition.
- Employees of any Philips company or creative agencies working for Philips and members of their families are not eligible to win a prize.
- Winners shall be liable for any taxes and/or surcharges that may be levied on the prize and for any expenses not specified in the prize description.
- Prizes shall be awarded at Philips’ sole discretion. There shall be no correspondence concerning the awarding of prizes. The prize shall be accepted “as is” by a winning participant. No cash alternative for prizes shall be offered and prizes are non-transferable and may not be exchanged or returned. Philips accepts no liability whatsoever for any deficiency or malfunctioning of any prize or for any damage incurred through such malfunctioning or deficiency, howsoever arising.
- Prizes may be subject to variation at the discretion of Philips. In the event it is necessary to vary the prize offered, Philips shall offer the winner a prize of a similar description or value where possible. Philips reserves the right to disqualify any participant and/or winner in its sole discretion.
- Failure to comply with any of these Rules will disqualify any participant from taking part in the competition.
- The participant agrees that Philips shall be allowed - in its sole discretion - to use the prize-winners’ name and/or image and submitted materials for promotional or advertising purposes freely and at no charge. However, Philips shall not be obliged to make any such use of names and/or images. Philips accepts all submitted materials on the basis that all necessary rights, title to and interest in copyrighted material shall be assigned to Philips by submission of such entry. However, Philips shall in no way be obligated to use such materials.
- These rules shall be governed by and interpreted in accordance with Dutch law and any disputes arising out of or in connection with them shall be subject to the exclusive jurisdiction of the competent court in Amsterdam, The Netherlands.
- The competition and all information accessible through the Twitter website is provided on an “as is “and “as available” basis without warranties of any kind. All rights are reserved.
- If any provision of these Rules is found to be invalid by any court having competent jurisdiction the invalidity of such provision shall not affect the validity of the remaining provisions of these Rules, which shall remain in full force and effect.
- The Competition is organised by Philips Consumer Lifestyle B.V. based in Eindhoven, The Netherlands. Further details are provided when double-clicking the “Philips” link in the footer of the Philips website.
- Philips needs your current correct address in order to be able to deliver the prize if you are a prizewinner. Your personal data will be stored in the Philips Global Consumer Database for administrative purposes. This database is notified to the Dutch Data Protection Authority under registration number 1166347. The data in this database are used in accordance with Dutch privacy laws and the Philips Privacy Policy (see the footer of the Philips website). This use may include informing you by e-mail about Philips products, services, events or other information that might be of interest to you. Your consent for this use is implied unless you have opt-out by ticking the opt-out tickbox at the time of registration.
